1. Prices

All prices listed on our website are displayed in US Dollars (USD $) or Euros (EUR €) and are net prices including packaging.

The Total Price depends on the product, the destination country, applicable import duties, taxes, and the selected shipping method.

Unless otherwise stated, the Total Price shown at checkout includes shipment under DDP (Delivered Duty Paid – Incoterms 2020) terms. This means that shipping costs, applicable import duties (tariffs), and customs clearance charges are included in the Total Price.

In jurisdictions where Rotrex is not legally required or permitted to collect local, state, federal taxes, sales tax, or VAT, such taxes (if applicable) may be charged to the customer by the freight forwarder or carrier upon delivery.

In jurisdictions where Rotrex is legally required to collect VAT or other indirect taxes, such taxes will be included in the Total Price at checkout.

Prices are subject to change without prior notice.

2. Payment

We accept the following payment methods:
VISA, VISA-Dankort, VISA Electron, Mastercard, PayPal and MobilePay.

Your payment method will be charged only when your order is shipped. All amounts are charged in USD ($) or EUR (€) unless stated otherwise. We are not responsible for currency exchange fees or conversion rates charged by your bank.

We reserve the right to cancel orders in cases of pricing errors or suspected fraud.

3. Shipping & Delivery

We ship worldwide under DDP terms.

Orders placed before 10:00 CEST are typically shipped the same business day if the item is in stock; otherwise, orders ship the next business day.

Delivery times vary by destination. Estimated transit time for stocked items is typically 5–7 business days, however All orders are subject to availability.

Goods are delivered to the address provided during checkout. Depending on destination, your shipment may be handled by different carriers. If a delivery location is full or inaccessible, the carrier may redirect to the nearest pickup location.

If any issues arise, please contact our customer service team.

Rotrex is not responsible for delays caused by customs processing, carrier backlogs, force majeure events, or other circumstances beyond our reasonable control.

Certain products may be subject to special delivery conditions, which will be clearly stated before checkout.

4. Inspection & Claims

You must inspect all goods promptly upon delivery and notify us of any defects or shipping damage within 7 days of receipt. Should the goods and the packaging be damaged upon receipt, please keep the goods and packaging intact until we notify you to dispose of it or return it either to Rotrex or to a third party appointed by Rotrex.

5. Warranty

Rotrex A/S provides a 12-month warranty against defects in materials and workmanship from the date of delivery, subject to applicable consumer law.

This warranty does not cover damage or defects caused by misuse, improper installation, unauthorised modifications, racing use, negligent handling, or normal wear.

Depending on the situation, we may:
• Repair the item
• Replace the item
• Issue a refund
• Issue a price reduction

Return shipping costs for valid warranty claims will be covered by Rotrex.

Cash-on-delivery or freight-collect shipments will not be accepted.

6. Returns & Right of Withdrawal (Consumers Only)

Consumers have the right to withdraw from the purchase within 14 days of receiving the goods, without providing a reason.

The withdrawal period begins on the date:
• You receive the goods, or
• You receive the last item in a multi-item order, or
• You receive the last batch/part in case of partial deliveries, or
• You receive the first delivery in recurring delivery arrangements.

To exercise this right, you must notify us via email at [email protected] within 14 days of receipt. Goods must be returned within 14 days after notification.

Reimbursement will be for the full amount stated on the invoice minus any return shipping costs incurred by Rotrex.

Returns must be shipped to either:

—or at the sole choice of Rotrex—
to a third party appointed by Rotrex.

Refusal to accept delivery without providing notice does not constitute lawful withdrawal.

Items Excluded from Withdrawal

The right of withdrawal does not apply to:
• Custom-made or customized products
• Sealed goods where seals are broken and cannot be returned for health or hygiene reasons
• Goods irreversibly mixed with other goods after delivery
• Digital content not supplied on a physical medium after performance has begun
• Goods that degrade or expire quickly

7. Condition of Returned Goods

You are liable for any diminished value caused by handling beyond what is necessary to determine the nature, characteristics, and functionality of the goods (equivalent to trying items in a retail store). If the product has been used beyond this, we may reduce or reject in full the refunded amount accordingly.

8. Refunds

If you withdraw from a purchase, we will refund the amount paid for the product, including original standard shipping costs (not including additional charges for premium delivery options), minus any return shipping costs imposed on Rotrex.

Refunds will be issued without undue delay and no later than 14 days after receiving your withdrawal notice. We may withhold the refund until we receive the returned goods or proof of shipment, whichever occurs first.

Refunds will be issued to the original payment method unless otherwise agreed.

9. Personal Data & Privacy

To process your order, we require the following information:
• Name
• Address
• Phone number
• Email address
• Purchase details (order number)

In case you purchase goods on behalf of an entity a EIN / company registration number will be required.

We process personal data to fulfill your order, provide support, and meet legal obligations. For full information on data processing, storage, and your rights, please refer to our Privacy Policy available on our website.

10. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of Denmark, without regard to conflict-of-law rules. This does not deprive consumers of mandatory protections in their country of residence.

Consumers within the EU may submit disputes to the EU Online Dispute Resolution platform.

Consumers outside the EU may have additional rights under applicable local laws.

11. Limitation of Liability (Non-Consumer Purchases)

To the maximum extent permitted by law, Rotrex A/S shall not be liable for indirect, consequential, punitive, or incidental damages, including loss of profit or business interruption.

Nothing in these Terms shall limit liability for death, personal injury, gross negligence, or other liability that cannot legally be excluded.

ADDITIONAL TERMS FOR PERFORMANCE AUTOMOTIVE PRODUCTS

12. Intended Use & Vehicle Modification Notice

Many Rotrex products are performance automotive components that may modify vehicle power output, emissions characteristics, and operating behavior. Such modifications may:
• Void OEM warranties
• Reduce component lifespan
• Affect emissions compliance
• Require professional installation and supporting modifications

Customers are responsible for ensuring compatibility and safe installation.

13. Professional Installation Required

Rotrex strongly recommends installation by qualified, professional automotive technicians experienced with performance powertrain systems.

Improper installation can cause severe engine damage, component failure, personal injury, or property damage. Rotrex is not responsible for damages caused by improper installation, tuning, or vehicle setup.

14. Racing / Off-Highway Use Disclaimer

Unless explicitly stated otherwise in writing, Rotrex products are not certified for public-road use in jurisdictions requiring emissions compliance and may be designated “For Racing / Off-Highway Use Only.”

By purchasing, you acknowledge that:
• Public-road use may be illegal in certain jurisdictions
• Emissions compliance requirements vary
• You are solely responsible for compliance with applicable laws

Rotrex does not guarantee emissions legality unless a product is clearly labeled as such.

15. U.S. EPA, CARB, and Emissions Compliance (U.S. Customers)

Some components may not be legal for sale or use in California or other states adopting California emissions rules unless they possess a valid CARB Executive Order (E.O.) number.

It is the buyer’s responsibility to verify emissions classification before purchase or installation.

16. Performance Variability

Performance outcomes vary depending on factors including:
• Engine condition
• Supporting modifications
• Fuel type and quality
• Tuning/calibration
• Ambient conditions

Rotrex does not guarantee specific horsepower, torque, acceleration, performance, or emissions results.

17. Assumption of Risk

By purchasing, installing, or using performance automotive products, you acknowledge that powertrain modification carries inherent risk, including:
• Mechanical or engine damage
• Increased wear
• Reduced reliability
• Increased operating temperatures
• Higher fuel consumption
• Safety hazards

You voluntarily assume all such risks.

18. Limited Warranty (Modified for Performance Use)

Rotrex provides a warranty against defects in materials and workmanship under normal use. The warranty does not cover:
• Competition, racing, track, or off-road use
• Improper or unprofessional installation
• Failure due to insufficient lubrication or cooling
• Detonation, lean conditions, or inadequate tuning
• Misuse, abuse, or negligence
• Modifications to supplied components
• Use with incompatible aftermarket parts

Warranty claims may require proof of compliant installation and recommended maintenance.

19. Disclaimer of Liability for Tuning & Calibration

Rotrex does not provide engine calibration services and is not responsible for:
• ECU tuning strategies
• Engine control settings
• Fuel system configuration
• Ignition timing
• Air/fuel ratios

Incorrect tuning can cause catastrophic engine damage. Customer assumes full responsibility for proper tuning.

20. Limitation of Liability

To the fullest extent permitted by law, Rotrex, its officers, directors, employees, and suppliers shall not be liable for:
• Engine or drivetrain damage
• Vehicle damage
• Personal injury or death
• Property loss
• Loss of time or income
• Loss of vehicle use
• Towing or recovery costs
• Indirect, incidental, special, punitive, or consequential damages

Even if advised of the possibility of such damages. In jurisdictions where such limitations are restricted, liability shall not exceed the purchase price of the product giving rise to the claim.

21. No Implied Warranties (Where Permitted by Law)

To the fullest extent permitted by law, Rotrex disclaims all implied warranties including, without limitation:
• Implied warranty of merchantability
• Implied warranty of fitness for a particular purpose

Where such disclaimers are not permitted, the duration of any implied warranty is limited to the duration of the express warranty.

22. Export, Import & Regulatory Compliance

Performance automotive products may be subject to import restrictions, export controls, customs classifications, regulatory approvals, laws and regulations. The buyer is responsible for complying with all of before mentioned restrictions, classifications, regulations, laws and regulations in their jurisdiction.

Rotrex makes no representation regarding legality or suitability of product use outside Denmark unless explicitly stated in writing.

US Export Regulations

Buyer may not directly or indirectly import, re-import, export, re-export, sell, distribute or otherwise make available the goods for use in any country in the world contrary to the then-current US Export Regulations including e.g. Cuba, Iran, North Korea, Russia, Sudan and Syria. The aforesaid listing of countries is not exhaustive and is subject to change.
